The petitioner seeks bail in F.No. NCB/PZU/V14/2020 corresponding to Special Case No. 43 of 2020, registered for the offence punishable under Sections 8(C), 18, 25, 27(A), 28, 29 and 59 of the Narcotic Drugs and Psychotropic Substances Act.

As per the prosecution case, on secret information a raid was conducted. On search, 15 KG of Opium which were concealed in two vehicles were recovered and four accused persons were apprehended on the spot. Out of them two persons namely, Vijay Singh and Shyam Bihari named the other coaccused persons who were supplier of the said Opium including

No.54199 of 2021(4) dt.09-03-2022 2/3 the name of Rajesh Kumar Yadav who in his confessional statement named this petitioner and stated that this petitioner has good relation with NCB officials and leaders. It is submitted on behalf of the petitioner that nothing has been recovered from conscious possession of this petitioner. Petitioner is neither driver nor owner of vehicles in question. He is not even the supplier and not the resident of said locality and he is only alleged to have good relation with NCB officials and leaders. Petitioner is in custody since 22.04.2021 having no criminal antecedent.

Learned counsel for the State however vehemently opposed the prayer for bail and submitted that this petitioner performed the role of mediator between the NCB officials and supplier of narcotic substance.

Considering the facts and circumstances and materials available on record, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge Ist, Gaya in connection with F.No. NCB/PZU/V-14/2020 corresponding to Special Case No. 43 of 2020, subject to following conditions:- (i) The petitioner shall co-operate in the trial and shall
