JUSTICE ARUN KUMAR ORAL ORDER 17-02-2018 Heard learned Counsel for the petitioner and the State as also the learned Counsel appearing on behalf of the informant. Petitioner, already in custody, seeks bail in Navanagar PS Case No. 118 of 2017 registered under Sections 341, 326-A, 307 and 504/34 of the IPC.

The allegation in brief is that while the informant was returning back to his home all the accused persons intercepted, Ashok Singh exhorted Shiv Narayan Singh to throw acid and accordingly he threw acid on his body and escaped away. Learned Counsel for the petitioner submits that no overt act is alleged against the petitioner except that he too was present there along with other co-accused, but acid was thrown by Shiv Narayan Singh on the order of Ashok Singh.

Learned Counsel for the informant opposed the prayer for bail and submitted that this petitioner was also present and has got criminal antecedent,.

Having considered the said facts and circumstances in particular absence of any overt act, the petitioner, namely, Narayan Singh @ Narayan Pratap Singh is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Buxar in connection with Navanagar PS Case No. 118 of 2017.
