2. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Muzaffarpur Town P.S. Case No. 623 of 2022 instituted for the offence under Sections 420 and 379 of the Indian Penal Code.

3. The case of the prosecution is that the petitioner has made a call to the informant on OLX that he intends to sell his bike bearing registration no. BR 06 BZ 4573. It is also alleged that the mobile from which the talk was completed is 8260891052.

4. Learned counsel for the petitioner has submitted that from perusal of the FIR it will transpire that no amount has been transferred in his account rather Rs.41,500/- has been

Learned counsel further submits that the said mobile number does not belong to the petitioner and he has not received any money from the informant. The petitioner is a man of clean antecedent.

5. Learned APP appearing for the State opposed the prayer of bail of the petitioner.

6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Muzaffarpur Town P.S. Case No. 623 of 2022, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur subject to the conditions as laid down under Section 482(2) of the BNSS.

7. Accordingly, the present bail application stand allowed.
