The petitioner has preferred this application for grant of regular bail in a case registered under sections 30(a) and 32(1), 32(3), 41(1) and 41(2) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, 100 litres of liquor is said to have been recovered from the e-rickshaw of which the petitioner was the driver.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his possession or his e-rickshaw. He has been falsely implicated in the case. He is in custody since 22.7.2021 and has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the petitioner having remained in custody for more than 8 months and having no criminal antecedent, the Court directs the petitioner to be enlarged on bail in connection with Special Case no. 4489 of 2021 (arising out of Alamganj R.R Case no. 75 of 2021) on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna.
