JUSTICE RAVI RANJAN ORAL ORDER 27-01-2016 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in a case registered for the offence punishable under Section 414 of the Indian Penal Code, Sections 47 (F), 13 (F) and 48 of the Excise Act and under Rule 2 (5)/3/4 (kh)/18 of Mahua Flower Rule.
The allegation is of recovery of 30 bags of Mahua flowers weighing about 12 quintals from the portion of house of covillager which has allegedly been taken on rent by the petitioner and are capable of being used as raw materials for manufacture of illicit liquor.
It is contended that there is no evidence that the petitioner has taken such portion of house on rent and the petitioner's antecedent is clean.
Having regard to the facts and circumstances of the
Patna High Court Cr.Misc. No.58409 of 2015 (2) dt.27-01-2016 2/2 case, let the petitioner, namely, Ramswaroop Sao be released on bail in the event of his arrest/surrender before the court below within a period of six weeks from today in connection with Atari P.S. Case No.191/2015, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-II, Gaya subject to the conditions as laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
