The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act. Allegation against the petitioner is that he along with other co-accused persons killed the informant's husband by shot fire.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. The petitioner has not named in F.I.R. rather the name of the petitioner came into light on the basis of confession made by co-accused namely, Karu Singh. There is no eye witness of the such occurrence and no any consistent evidence found against the petitioner. He has got no criminal antecedent. Similarly situated co-accused namely Amarjeet Kumar has already been granted bail by a coordinate bench of this court vide order dated 25.8.2022 in Cr. Misc. No. 30040 of 2022. The petitioner is languishing in judicial custody since 4.1.2022.

Learned APP appearing for the state has vehemently opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Kotwali (Basudevpur) P.S. Case No. 02 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Munger.
