2. The instant application for anticipatory bail has been filed by the petitioners apprehending their arrest in connection with Ram Krishna Nagar P.S. Case no. 846 of 2024 instituted for the offence punishable under Sections 126(2), 115(2), 352, 351(2), 109, 132, 304, 3(5) of the BNSS.
3. As per allegation in the FIR, on the alleged date of occurrence, petitioners alongwith 10-15 unidentified persons, allegedly abused and assaulted the informant . It is further alleged that, with the intention to kill him, they pressed his neck
Patna High Court CR. MISC. No.45028 of 2025(3) dt.01-08-2025 2/3 and some of them snatched his gold chain and mobile. Anyhow, informant managed to get free from their clutches and fled away.
4. Learned counsel appearing on behalf of the petitioners has submitted that petitioners are innocent and has committed no offence. Petitioners were only member of the mob. Informant has not received any grievous injury still Section 109 of the BNSS is added in this case to make the case grievous. Moreover, after completion of investigation, chargesheet has been submitted against the petitioner. Neither the petitioner was arrested nor any incriminating article has been recovered from his possession.
5. Learned APP appearing for the State has opposed the prayer of Bail.
6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioners on bail. The petitioners are directed to surrender in the Court below within a period of four weeks from today and in the event of their arrest or surrender in connection with Ram Krishna Nagar P.S. Case no. 846 of 2024, they will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of
Patna High Court CR. MISC. No.45028 of 2025(3) dt.01-08-2025 3/3 the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class- 15 Patna subject to the conditions as laid down under section 482 of the BNSS.
