JUSTICE ARUN KUMAR ORAL ORDER 19-12-2017 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Akbarpur PS Case No. 221 of 2014 registered under Sections 147, 148, 149, 341, 323 and 304 of the IPC.

The allegation in brief is that the deceased was called from his home by Sudhir Ravidas, who brought him to the house of Bhola Ravidas and tied him on the allegation of committing theft and all the accused persons assaulted him as a result of which he succumbed to the injuries.

Learned Counsel for the petitioner submits that there is no specific allegation against the petitioner, there is general and omnibus allegation of assault but according to Post Mortem Report only one fatal injury was found on the person of deceased and two co-accused similarly situated namely Sudhir Ravidas and Bhola Ravidas have been admitted to bail by a coordinate Bench of this Court. The petitioner has clean antecedent and has remained in custody since 11.10.2017.

Having considered the said facts and circumstances, the petitioner, namely, Birendra Ravidas @ Pappu Ravidas is directed to be

Patna High Court Cr.Misc. No.60900 of 2017 (2) dt.19-12-2017 released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Nawada in connection with Akbarpur PS Case No. 221 of 2014.
