Petitioner seeks bail in Pirpainty P.S. Case No. 62 of 2017 instituted for the offence under Section(s) 366(A) and 504/34 Indian Penal Code.
In the written report it is alleged that petitioner enticed the niece of informant namely, Sindhu Kumari, with intention to perform marriage with her. The informant went to the house of petitioner to enquire about her niece, then parents of the petitioner abused the informant.
Case diary has been received.
The statement of victim girl recorded under Section 164 Cr. P.C. is available in the case diary wherein she has stated her age as 16 years and the court has also assessed her age to be
Patna High Court Cr.Misc. No.68983 of 2018(3) dt.12-12-2018 2/2 16 years. She has stated in her statement that she moved to various places with petitioner. She never raised any alarm. She has not levelled allegation against the petitioner of committing illegal act with her during period of stay with him. The victim girl has been medically examined. The Medical Board has assessed her age below 18 years. The Doctor has found no evidence of recent sexual intercourse. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the 1st Additional Sessions Judge, Bhagalpur, in connection with Pirpainty P.S. Case No. 62 of 2017, subject to the condition that both the bailors shall be close relative of the petitioner.
