The petitioners seek anticipatory bail in a case instituted for the offence under Sections 363 and 366A/34 of the Indian Penal Code.

It is alleged in the written report that sister of the informant has been kidnapped by the petitioners along with other accused.

The attention of the Court was brought to the statement of the victim girl recorded under Section 164 Cr. P.C. annexed as Annexure-2 wherein the victim girl has stated that she was in love with Indal Kumar for the last one year and was willing

Patna High Court Cr.Misc. No.1398 of 2017 (2) dt.16-01-2017 2/2 to marry him but her parents were not agree. She had gone voluntarily with Indal Kumar on 17.3.2016 to Mumbai and married him. She has also stated in her statement that she is six months pregnant and wants to live with her husband. In such circumstances, since the petitioners are the family members of Indal Kumar, let them in the event of surrender, named above, within six weeks from the date of receipt of this order, in connection with Sakari P.S. Case No. 26 of 2016 corresponding to G.R. No. 685 of 2016, shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Madhubani, subject to the condition laid down under Sections 438 (2) Cr.
