The petitioners apprehend their arrest in connection with Sono P.S. Case No. 225 of 2019 registered under Sections 147, 148, 149, 341, 323, 324, 325, 308, 435, 504 and 506 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioners submits that petitioners are innocent and have falsely been implicated in the present case. There is no specific allegation against the petitioner no. 1. Further submission is that petitioners have no criminal antecedent.
Learned A.P.P. appearing on behalf of the State opposed
Patna High Court CR. MISC. No.39906 of 2020(3) dt.26-11-2021 2/2 the prayer of petitioner no. 2 by contending that the first information report itself shows that there is direct allegation of assault against him on the head of the informant's niece. The injury report also corroborates the same.
Having considered the facts and circumstances of the case, prayer of the petitioner no. 2 for grant of anticipatory bail is rejected.
So far as prayer of petitioner no. 1 is concerned, his prayer for grant of anticipatory bail is allowed. Let the above named petitioner no. 1 be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of the Judicial Magistrate 1st Class, Jamui in connection with Sono P.S. Case No. 225 of 2019, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Arvind Srivastava, J) utkarsh/- U T
