JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 25-01-2016 Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for the State. This application for grant of anticipatory bail arises out of Hajipur Town PS Case No.626/2015, disclosing offences under Sections 406 and 420/34 of the Indian Penal Code.

The complaint case filed by the informant registered as Complaint Case No. 2578/2015 in the court of learned Chief Judicial Magistrate, Vaishali, is the basis for registration of the present FIR under Section 156(3) Cr.P.C. Learned counsel appearing on behalf of the petitioners, while denying the prosecution case submits that

Patna High Court Cr.Misc. No.58086 of 2015 (2) dt.25-01-2016 2/2 dispute between the informant and these petitioners in relation to business transaction is the reason behind the institution of the present case. He has further submitted referring to paragraph 3 of the application that the petitioners have no criminal antecedents.

In view of the submission and the nature of accusation, this application is allowed. It is directed that in the event of arrest, the petitioners above-named, shall be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Hajipur, Vaishali, in connection with Hajipur Town PS Case No.626/2015, subject to the conditions as laid down under Section 438(2) CrPC.
