Mr.Kumar Ranjit Ranjan, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SHAILENDRA SINGH ORAL ORDER 22-11-2022 The learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month.

Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks regular bail in connection with Rafiganj P.S. Case No. 200 of 2020 registered for the offences punishable under Sections 379 and 461 of the Indian Penal Code. Allegedly, from the shop of the informant Laptops, Mobile Phones and cash amount of Rs. 15,000/- were stolen by some unknown persons.

The main submissions advanced by learned counsel Mrs. Malti Kumari, appearing for the petitioner are that the petitioner has clean antecedent and has been languishing in jail

Patna High Court CR. MISC. No.43698 of 2022(2) dt.22-11-2022 2/2 since 17.06.2022 and his old mother aged about 65 years is alone at his home and there is nobody to look after her, as per the prosecution the petitioner was found using one of the stolen mobile phones and against him investigation has been completed.

Learned APP Mr. Kumar Ranjit Ranjan, appearing for the State has opposed the prayer for bail.

In view of above submissions and mainly considering the petitioner's custody period and his clean antecedent and also the fact that the investigation has been completed against him as per the above submission and the alleged offences are triable by First Class Magistrate, in the opinion of this Court the petitioner deserves to a lenient approach of this Court. Accordingly, let the petitioner be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Court concerned in connection with Rafiganj P.S. Case No. 200 of 2020.
