JUSTICE ASHOK KUMAR PANDEY ORAL ORDER 15-09-2025 Heard Mr. Ghanshyam Tiwary, learned counsel for the petitioner, Chandra Sen Prasad Singh, learned APP for the State as well as Mr. Sunil Kumar Pathak, learned counsel appearing on behalf of the informant.
2. The petitioner has prayed for bail in connection with Shahpur P.S. Case No.182 of 2024, registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 364, 387 and 120(B) of the Indian Penal Code.
3. The case of the prosecution is that the petitioner along with other accused persons abducted the brother of the informant due to non-fulfillment of demand of extortion money.
4. Learned counsel for the petitioner has submitted that earlier the prayer for bail of the petitioner was rejected vide order dated 13.12.2024, passed in Cr. Misc. No.77101 of 2024 by a learned co-ordinate Bench of this Court with a liberty that the
Patna High Court CR. MISC. No.45989 of 2025(3) dt.15-09-2025 2/2 petitioner shall renew his prayer for bail after framing of charge. It is submitted that from the report of the learned trial court, it transpires that charge has been framed. It has also been submitted by learned counsel for the petitioner that another co-accused, namely, Shivam Kumar, whose bail petition was also rejected with same observation, has been granted bail by a learned co-ordinate Bench of this Court vide order dated 18.08.2025, passed in Cr. Misc. No.47530 of 2025. It is further submitted that the case of the petitioner stands on similar footing. The petitioner is languishing in judicial custody since 09.07.2024.
5. Learned APP for the State and learned counsel for the informant vehemently opposed the bail application.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Danapur in connection with Shahpur P.S.
