The petitioner seeks regular bail in connection with Jai Nagar P.S. Case No.197 of 2017 instituted for the offences under Sections 272, 273, 29 of the Indian Penal Code and 30(a) 37(B), 37(C) of the Bihar Prohibition and Excise Act, 2016 and 20/22 N.D.P.S. Act.
The allegation in the present case is regarding recovery of 42 litres Nepali wine and 250 gram Ganja from the phoos house of the petitioner.
The learned counsel for the petitioner submits that the petitioner is innocent, he has got no criminal antecedent and is languishing in custody since 18.07.2017.
Patna High Court Cr.Misc. No.60791 of 2017 (2) dt.21-12-2017 2/2 Considering the nature of accusation, the period of custody already undergone and the fact that the petitioner has got a clean antecedent, I direct the petitioner named above to be released on regular bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Madhubani in connection with Jai Nagar P.S.
