The petitioner seeks bail in connection with Bairgania P.S. Case No.136/2020 registered for the offence punishable under Sections 461 and 379 of the Indian Penal Code. As per the prosecution case, the petitioner along with F.I.R. named accused persons and three to four unknown persons committed theft in the shop of the informant and they were seen in the CCTV footage of adjacent house. It is submitted by learned counsel for the petitioner that the petitioner is quite innocent and has not committed any offence as alleged in the FIR and has been falsely implicated in this case. No incriminating article has been recovered from his conscious physical possession. His name has been dragged in

Patna High Court CR. MISC. No.39908 of 2020(3) dt.19-03-2021 2/2 this case with malicious intention at the hands of his enemy in collusion with the police. Similarly situated co-accused persons namely Indal Mahto and Sanjay Mahto have been enlarged on bail by a co-ordinate Bench of this Hon'ble Court vide order dated 26.02.2021 passed in Cr.Misc. No.40811 of 2020 and 01.03.2021 passed in Cr.Misc. No. 39373 of 2020 respectively. The petitioner has no criminal antecedent and has been languishing in custody since 10.08.2020 Learned APP for the State opposed the bail petition. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below in connection with Bairgania P.S. Case No.136/2020.
