JUSTICE RANJAN KUMAR JHA ORAL ORDER 23-07-2026 Heard learned counsel appearing on behalf of the petitioners and learned Additional Public Prosecutor appearing on behalf of the State.

2. The petitioners are apprehending their arrest in connection with Bairiya P.S. Case No.192 of 2026 registered for the offences punishable under Sections 126(2), 115(2), 118(1), 118(2), 109, 352, 351(2), 3(5) of the BNS.

3. The prosecution case, in brief, is that a panchayati was in progress between the parties. On the next date fixed during the course of the said panchayati, all the petitioners allegedly assaulted the informant and her son, causing injuries to them.

4. Learned counsel for the petitioners submits that there is an admitted land dispute between the parties and that, even on earlier occasions, the petitioners were falsely implicated. Learned counsel has further drawn the attention of this Court to the nature of the injuries, which have been opined by the doctor to be simple. The counsel for the petitioners make a statement at bar that all the cases in which they were earlier arrayed as an accused has been lodged by informant side.

Learned APP for the State, assisted by learned counsel for the informant, vehemently opposes the prayer for anticipatory bail and submits that the victim is a poor lady who has been continuously victimized by the petitioners. It is further submitted that this is the fourth occasion on which the petitioners have taken the law into their own hands.

6. Having considered the rival submissions of the parties, particularly the fact that there is an admitted land dispute between the parties, that the petitioners have been made

No.46036 of 2026(3) dt.23-07-2026 3/3 accused in the earlier cases instituted at the instance of the informant side, and that the injuries sustained by the victims have been opined to be simple in nature, let above named petitioners, in the event of their arrest or surrender before the learned trial Court, within a period of four weeks of the order, are directed to be released on bail furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-XIII, Bettiah, West Champaran/concerned Court where the case is pending in connection with Bairiya P.S. Case No.192 of 2026 subject to the conditions as laid down under Section 482(2) of the BNSS.
