JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 19-12-2016 Heard learned counsel for the petitioner and learned counsel representing the State.

Petitioner apprehends her arrest in connection with Barauni (Garahra) P.S. Case No. 273 of 2016 registered for the offences punishable under Sections 323, 324, 307, 504/34 of the Indian Penal Code.

Allegedly, the petitioner poured hot oil on the body of the informant and for that he was treated in Life Line Hospital and after returning from hospital, the informant lodged this case. Submission is of false implication and that the occurrence is of 31.05.2016 and the FIR has been lodged on 16.07.2016 after much delay without any explanation only with a view to take revenge out of family feud. Now good sense has prevailed and the informant has filed compromise petition also vide annexure 3 and as such the petitioner being lady deserves sympathetic

Learned APP fairly submits that in view of the compromise arrived at between the parties lenient view can be taken.

In the facts and circumstances stated above, the petitioner above named, in case of her arrest or surrender within four weeks from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Barauni (Garahra) P.S. Case No. 273 of 2016, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
