2. From the earlier order dated 10.11.2025 passed by a Co-ordinate Bench of this Court, the instant anticipatory bail petition stands withdrawn as against the petitioner no.1, namely, Arun Kumar. Accordingly, the present order remains confined only to the petitioner nos. 2 & 3 namely, Satyendra Singh and Prince Kumar respectively.
3. The petitioners are apprehending their arrest in connection with Fesar P.S. Case No. 28 of 2025 registered under Sections 126(2)/115(2)/61(2)/109/303(2)/351(2)/352/3(5) of the
Patna High Court CR. MISC. No.42591 of 2025(5) dt.03-12-2025 2/3 Bhartiya Nyaya Sanhita, 2023 and Section 3/4 of the Bitch Practices Act.
4. As per prosecution case, the named accused persons including the petitioners assaulted the informant and his father while they were going to his house from the field.
5. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in the present case. He further submits that only one injury was found upon the head of the injured Awadhesh Singh and the same is not attributed against both the petitioners.
6. Learned APP for the State has opposed the prayer for anticipatory bail of the petitioners.
7. The allegation against the petitioner no.3, namely, Prince Kumar is of assaulting the injured Awadhesh Singh on his back. So far as petitioner no.2, namely, Satyendra Singh is concerned, the allegation as against him is general and omnibus in nature. The injury suffered by Awadhesh Singh is not attributed against these two petitioners.
8. Considering the aforesaid facts and circumstances of the case, let the petitioner nos. 2 & 3, above named, in the event of arrest/surrender before the learned court below within a period of four weeks from today, be released on anticipatory bail
Patna High Court CR. MISC. No.42591 of 2025(5) dt.03-12-2025 3/3 on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Fesar P.S. Case No. 28 of 2025, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure/ 482(2) of the B.N.S.S., 2023.
