JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 01-02-2016 Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the State. This application for grant of anticipatory bail arises out of Kopa PS Case No.31/2015 disclosing offences under Sections 147, 148, 149, 323, 504, 506 and 307 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner has straightway taken me to an order dated 26.11.2015, passed by this Court in Cr. Misc. No. 46109 of 2015 (Om Prakash Rai & Ors. Vs. State of Bihar) and Cr. Misc. 46330 of 2015 (Jitendra Rai vs. State of Bihar), to submit that upon accepting the submission that the informant's side was the aggressor, this Court has granted anticipatory bail to other

Patna High Court Cr.Misc. No.58621 of 2015 (2) dt.02-02-2016 2/2 co-accused persons.

I find substance in the submission made on behalf of the petitioner. Accordingly, this application is allowed. It is directed that in the event of his arrest, the petitioner above-named, shall be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Mr. Arvind, learned Judicial Magistrate, Saran at Chapra, in connection with Kopa PS Case No.31 of 2015, subject to the conditions as laid down under Section 438(2) CrPC. This is subject to the further condition that the petitioner shall present himself before the police/Court below, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
