JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-11-2017 Earlier, prayer for bail of the petitioner was rejected vide order dated 08.02.2017 passed in Cr. Misc. No. 29293 of 2016 at that stage with a direction to the trial court to expedite the trial and try to conclude it within a period of six months with a further direction to the court below to see that no any witness will be returned and if due to paucity of time, any witness may not be examined on that day, on the very next day, he /she will be examined so that the trial may be concluded soon. Learned counsel for the petitioner submits that the petitioner is in custody for more than 51⁄2 years but the trial of the petitioner has not been concluded as yet.
From the report of the learned trial court, it appears
Patna High Court Cr.Misc. No.53992 of 2017 (3) dt.29-11-2017 that now case has been fixed for argument.
In that view of the matter, I am not inclined to grant bail to the petitioner. The prayer for bail of the petitioner is rejected. However, learned trial court is directed to conclude the trial within a period of two months.
