JUSTICE RAVI RANJAN ORAL ORDER 25-01-2016 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in a case registered for the offence punishable under Section 25 (1-B)-A/26/27 of the Arms Act.

It is contended that the allegation against the petitioner is that upon wrong fardbeyan given by him, a false case was instituted under the Arms Act. It is urged that on that count the petitioner can only be prosecuted either under Section 182 or Section 211 of the Indian Penal Code but different provisions of the Arms Act would not be attracted in this case as there is no recovery of arms and ammunitions from the petitioner.
