JUSTICE ARUN KUMAR ORAL ORDER 23-01-2018 Both the bail applications (Cr. Misc. No. 59984 of 2017 and Cr. Misc. No. 60181 of 2017) are being disposed of by this common order as both the cases arise out of the same FIR. Heard learned Counsel for the petitioners and the State. Petitioners, already in custody, seek bail in Bisfi PS Case No. 260 of 2016 registered under Sections 302 and 201 of the IPC. The FIR is against unknown and the allegation is that the petitioners are suspected to have killed the informant's son due to
Patna High Court Cr.Misc. No.59984 of 2017 (3) dt.23-01-2018 enmity.
Learned Counsel for the petitioners submits that the FIR is against unknown and except that some people heard the petitioners saying to kill somebody by strangulation there is no other material against the petitioners. The petitioners have clean antecedent and they are in custody since 5.10.2017.
Having considered the said facts and circumstances, the petitioners, namely, Sanjay Mahto, Pawan Kumar Mahto @ Pawan Kumar and Bharat Mahto are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) by each one of them with two sureties of the like amount each to the satisfaction of ACJM Benipatti in connection with Bisfi PS Case No. 260 of 2016. (Arun Kumar, J.) Snkumar/- U T
