The petitioner apprehends his arrest in Gaya Civil Line P.S. Case No. 292 of 2014 instituted for the offence under Section 420 of the Indian Penal Code.

The prayer for anticipatory bail of the petitioner was earlier rejected by Co-ordinate Bench of this Court vide Cr. Misc. No. 11715 of 2015 dated 02.07.2015. The petitioner has not surrendered even after rejection of the anticipatory bail. The petitioner has filed a fresh anticipatory bail petition. It has been submitted that during investigation, nothing has transpired against this petitioner. Since the anticipatory bail has already been rejected

Patna High Court Cr.Misc. No.34 of 2017 (3) dt.20-02-2017 2/2 by Co-ordinate Bench of this Court, this court is not inclined to grant the petitioner anticipatory bail.

Accordingly, this anticipatory bail petition is hereby rejected. The petitioner is directed to surrender before the court below within six weeks from today and seek regular bail which shall be disposed of by the court below in accordance with law without being prejudiced by this order.
