JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 147, 149 and 353 of the Indian Penal Code.

The prosecution case is that all the accused persons including the petitioner and 25-30 unknown, after forming an unlawful assembly, obstructed the Katihar-Manshi road and created obstruction in discharging official duties by the government servant.

It is submitted by learned counsel for the petitioner that for the same occurrence other case being Mansahi P.S. Case No.75/2015 was also registered by a Constable wherein the petitioner is not an accused.

Considering the nature of accusation, let the above

Patna High Court Cr.Misc. No.56857 of 2015 (2) dt.16-12-2015 2/2 named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, 2nd, Katihar in connection with Mansahi P.S. Case No.76/2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
