The petitioner seeks bail in Bhargama P.S. Case No. 175 of 2017 registered for the offence punishable under Section 395 of the Indian Penal Code.
Allegation against the petitioner is of committing dacoity.
It has been submitted on behalf of the petitioner that the petitioner has been falsely implicated in this case on mere suspicion. Petitioner has not been named in the First Information Report. It has been further submitted that nothing had been recovered from the possession of the petitioner. Petitioner has got no criminal antecedent and is in custody
Patna High Court Cr.Misc. No.60727 of 2017(3) dt.16-01-2018 2/2 since, 21.08.2017. Similarly situated co-accused has been granted bail by a co-ordinate bench of this Court vide order dated 11.01.2018 in Criminal Miscellaneous No. 62263 of 2017. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Bhargama P.S. Case No. 175 of 2017.
