The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 436/34 of the Indian Penal Code.

There is general and omnibus allegation that in the night all the five accused persons committed arson in the house of the complainant.

Submission is that allegation is based on complaint petition. The complaint was filed after lodging of the case by the wife of the petitioner vide Balia Belone Police Station Case No. 89 of 2014.

Considering the fact that the complainant is not an eye-witness of the occurrence and the allegation is general and

Patna High Court Cr.Misc. No.51959 of 2016 (2) dt.20-12-2016 2/2 omnibus against five accused persons, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar/Successor Court in connection with Complaint Case No. 1300 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
