The petitioner seeks regular bail in connection with Sadar Police Station Case No. 296 of 2020, registered for the offences punishable under Sections 399/402 of the Indian Penal Code and Sections 25(1-B)A/26/35 of the Arms Act. The allegation, as per the First Information Report, is that the police, on the basis of secret information that some miscreants have assembled and were planning to commit crime, proceeded towards the place of occurrence and arrested the petitioner as well as co-accused Amar Sharma and Md. Rehan and the police also recovered one loaded country-made pistol from the possession of the petitioner.

No.40274 of 2020(2) dt.26-02-2021 2/2 Learned Counsel for the petitioner submits that the petitioner has got no criminal antecedent and he has not committed any offence in the manner alleged. He next submits that the petitioner is in custody since 03.06.2020 and charge sheet has been submitted against the petitioner. Having heard learned Counsel for the parties and taking into consideration the materials on record and the fact that the petitioner is in custody since 03.06.2020, having no criminal antecedent and charge sheet has been submitted against him, I am inclined to grant regular bail to the petitioner. This application is, accordingly, allowed.

Let the petitioner, above named, be released on bail, upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur, in connection with Sadar Police Station Case No. 296 of 2020.
