2. The petitioner apprehends arrest in connection with Waris Nagar PS Case No.103 of 2025 dated 09.05.2025, instituted under Sections 319(2), 318(4), 338, 336(3), 340(2), 316(2), 111, 61(2) of the Bharatiya Nyaya Sanhita, 2023.
3. From the allegation in the FIR, it appears that the petitioner is a member of syndicate which used to cheat people in the garb of providing money for construction of the toilet. Specific allegation against the petitioner is that he runs a shop in which he used to change the address of the beneficiaries in the Aadhar Card.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this

It is further submitted that the petitioner has been made accused only on the disclosure made by Baby Khatoon, who stated that the petitioner used to correct the address of the beneficiaries in the Aadhar Card. Nothing incriminating has been recovered either from the possession of the petitioner or from the shop of the petitioner. Further submission is that petitioner has no concern either with sanction or disbursement of loan to the beneficiaries. Lastly, it is submitted that the petitioner has no criminal antecedents.
5. Learned APP has opposed the prayer for bail.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned JMFC, Samastipur, in Waris Nagar PS Case No.103 of 2025, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
7. The application stands allowed.
