This is an application for bail in connection with Jagdishpur P.S.Case No. 202 of 2017 registered for the offences punishable under Sections 420, 386, 341, 323, 504 and 506/34 of the Indian Penal Code.
Allegation as per FIR is that mother of informant has purchased 85 decimals of land by virtue of registered sale deed and land was mutated in her favour and petitioner demanded rangdari and threatened the informant to kill him. Submission of learned counsel for the petitioner is that informant claims to be purchaser of the land from one Rani Devi and Rani Devi executed Power of Attorney of land in favour of this petitioner for looking after the same and on the basis of Power of Attorney petitioner used to go to the land which was objected by the informant and as such false and concocted case has been filed against the petitioner to create pressure upon him. Patna High Court Cr.Misc. No.53071 of 2017 (2) dt.14-11-2017 2/2 submission is that he is in custody since 3.9.2017. Heard learned APP also.
Having heard both sides and in view of facts and circumstances as dispute is civil nature, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur, in connection with Jagdishpur P.S.Case No. 202 of 2017, G.R.No. 2501 of 2017, subject to the following conditions : (1) One of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned, (2) Petitioner shall co-operate in trial and appear on each and every date in court and on failure to appear on two consecutive dates without any genuine ground or without permission of court, his bail bond shall be cancelled.
