The FIR arises out of Ara Muffasil P.S. Case No. 136 of 2020 dated 05.05.2020 instituted under Sections 147, 148, 149, 341, 323, 307, 302, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act. The informant is Shiv Shankar Rai. The direct allegation against the petitioner is that he hit the head of the informant by iron rod causing injury to him. The other accused alleged to have resorted indiscriminate firing are Bijendra Rai who shot dead Triloki Shankar Rai while Pappu Rai fired on Hari Shankar Rai. Considering the fact that the specific role is attributed to the petitioner herein, I am not inclined to grant the privilege
