Heard the learned counsel for the petitioner and learned counsel for the State.

The petitioner apprehends his arrest for the offences alleged under Sections 25(1-b)a/26/35 of the Arms Act, registered in connection with Nanpur P.S.Case No. 314 of 2020. As per allegation, three accused persons armed with weapons came in the market. The informant with his friend tried to apprehend them, two of them succeeded in fleeing away and the petitioner was apprehended. He disclosed his name as Md. Ejaj @ Moin.

Considering the above facts and circumstances of the case, the petitioner is directed to surrender in the court below and if he files an application for regular bail, the same shall be disposed of on the same day, without being prejudiced by this order. The learned court below may take notice of the fact that the petitioner was on police bail and the investigating authority did not require his custodial interrogation.

With these observations, the application stands disposed of.

Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
