Petitioners apprehend their arrest in connection with Ben P.S. Case No. 03 of 2016 registered under Sections-147, 341, 323, 504, 506, 308, 447 of the Indian Penal Code. Counsel for the petitioners submits that both parties are agnates and there is an admitted land dispute between the parties. It is also submitted that the allegation is general and omnibus. It is further submitted that the injuries, so received by the injured persons, are simple in nature.
Considering the above-said facts and circumstances of the case as well as submission of the parties, this anticipatory
Patna High Court Cr.Misc. No.54850 of 2016 (4) dt.22-02-2017 2/2 bail petition is allowed and it is ordered that the petitioners named above, in the event of their arrest or surrender in the court below within four weeks from the date of receipt/production of copy of this order, shall be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Ben P.S. Case No. 03 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Bihar Sharif Patna subject to conditions as laid down u/S 438(2) of the Code of Criminal Procedure.
