JUSTICE RAVI RANJAN ORAL ORDER 27-01-2016 Heard learned counsel for the petitioners and the State. Petitioners apprehend their arrest in a case registered for the offences punishable under sections 147, 148, 149, 307 and 353 of the Indian Penal Code and section 27 of the Arms Act. It is contended that there is admitted land dispute between the parties and, as per the allegation, both the parties were firing on each other for the purpose of taking possession of the land in dispute. It is further contended that there is no injury upon any side and there are three versions of the occurrence as three First Information reports have been lodged. It is also contended that
Patna High Court Cr.Misc. No.58346 of 2015 (2) dt.27-01-2016 four of the accused persons, namely, Ramdeo Thakur, Devanand Thakur @ Tunnu Thakur, Manoj Thakur and Rajesh Thakur, have already been enlarged on bail vide order dated 02.12.2015 passed by a Coordinate Bench of this Court in Criminal Miscellaneous No. 54479 of 2015.
Having regard to the facts and circumstances of the case, let the abovenamed petitioners, namely, Satrohan Ray @ Rohan Ray, Jitendra Ray @ Jitendra Kumar Ray, Shiv Pukar Ray, Shiv Dayal Ray and Pahalwan Ray @ Puhalwan Ray, be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Shahpur Police Station Case No. 226/15 on furnishing bail bonds of Rs.10,000/- ( Ten Thousand Rupees) each with two sureties of the like amount each to the satisfaction of Sri R. Prasad, Judicial Magistrate, Ist Class, Bhojpur at Ara, subject to the conditions laid down under subsection (2) of Section 438 of the Code of Criminal Procedure. (Dr. Ravi Ranjan, J) SC/- U T
