The petitioner seeks bail in connection with Chhatauni P.S. Case no. 193 of 2017 registered for the offence punishable under Sections 384 and 387 of the Indian Penal Code.
Rs. 5 lacs is said to have been demanded as extortion from the informant under threat of dire consequences by mobile phone by unknown miscreant.
It is submitted by the learned counsel for the petitioner that the petitioner has no concern with the said occurrence. He happens to be owner of the shop vending mobile phone and wrist watch. During the course of
Patna High Court Cr.Misc. No.53748 of 2017 (2) dt.09-11-2017 2/2 investigation, the SIM card used in making extortion call was recovered from possession of co-accused Pradeep Paswan which is in the name of one Sima Kumari and the said SIM card was purchased from the shop of the petitioner. The petitioner happens to be only vendor of the said SIM card to Sima Kumari on proper verification of her identity. The petitioner has been languishing in custody since 21.08.2017.
Considering the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, District-East Champaran in connection with Chhatauni P.S. Case no. 193 of 2017.
