The petitioner seeks bail in connection with Chapra Muffasil P.S. Case No. 137/2017, registered for the offence punishable under Sections 25(1-b)(a), 26(3) and 35 of the Arms Act.

Three accused persons are said to have started fleeing away leaving the motorcycle seeing the Police party, but they were apprehended and from the possession of co-accused Dhiraj Kumar Singh one loaded country-made pistol was recovered. It is submitted by the learned counsel for the petitioner that no incriminating article has been recovered from the conscious possession of the petitioner rather from Dhiraj Kumar

Patna High Court Cr.Misc. No.53783 of 2017 (2) dt.09-11-2017 2/2 Singh. The petitioner has no knowledge of possessing the said fire-arm by the said co-accused. He has no criminal antecedent. He has been languishing in custody since 16.04.2017. Considering the facts and circumstance of the case, the above named petitioner, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge X, Saran at Chapra in connection with Chapra Muffasil P.S. Case No. 137/2017.
