ANJANA MISHRA ORAL ORDER 15-01-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner is apprehending her arrest in connection with Thakurganj (Pathamari) P.S. Case No. 19 of 2013 registered for offences punishable under Sections 302, 201/34 of the Indian Penal Code.
Earlier the matter had been rejected by this Court on the ground of delay and the same traveled to the Apex Court, where the matter was withdrawn with the liberty by the petitioner to approach this Court for appropriate consideration. Learned counsel for the petitioner submits that the name of the petitioner has been roped in the present case only because she is said to have love affair with the deceased. It is submitted that since the body of the lover of the present petitioner was found
Patna High Court Cr.Misc. No.57540 of 2015 (2) dt.15-01-2016 2/2 hanging on a tree, it was assumed that the petitioner had a hand to play in the said occurrence leading to the death of the deceased. It is further submitted that other brothers as well as co-accused persons including one of her uncles have already been extended the privilege of anticipatory bail by this Court in a series of order which have been appended to this application bearing Annexure-3. Considering the aforementioned facts and circumstances and also that the others co-accused has been granted the privilege of anticipatory bail, let the petitioner above named, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs.
10,000 (Rs. Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj in connection with Thakurganj (Pathamari) P.S. Case No. 19 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
