The petitioner apprehends his arrest in connection with Mahua P.S. Case No. 604/2019 registered for the offences punishable under Sections 302/328/34 of the Indian Penal Code. As per the prosecution case, the deceased died in his house and after his death, a case was filed that he has been poisoned by the entire family of his wife. The petitioner is also named in the F.I.R.
Learned counsel for the petitioner submits that the petitioner is not related with the family of the wife. In fact, he was a middle-man in the marriage, and, therefore, he has been falsely implicated in the present case.
Patna High Court CR. MISC. No.40317 of 2020(2) dt.27-10-2021 2/2 Considering the aforementioned circumstances and the fact that the deceased died in his own house and that the petitioner is a stranger to the family, the prayer for grant of anticipatory bail is allowed.
Let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali, Hajipur, in connection with Mahua P.S. Case No. 604/2019, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
