JUSTICE MOHIT KUMAR SHAH ORAL ORDER 01-05-2023 The present writ petition has been filed seeking the following relief:- "1. That, this is an application for issuance of an appropriate writ(s), order(s), direction(s) for quashing the order cum notice dated 25.06.2022, issued by the Circle Officer by which petitioner has been directed to remove/vacant the alleged encroachment from Khata No. 994, 436 situated at Mauza-Kakraul and after quashing the abovesaid notice dated 25.06.2022,
Patna High Court CWJC No.11471 of 2022(2) dt.01-05-2023 2/2 respondents be directed not to disturb the petitioner as he is residing on the abovesaid plot by constructing the pucca house as he has not encroached the same and to grant any other relief(s) for which petitioner may found entitled in accordance with law.
2. That the impugned notice dated 25.06.2022 is bad, illegal, malafide, arbitrary and a violation of Article 14 and 16 of the Constitution of India."
At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Circle Officer, Rahika, DistrictMadhubani for redressal of his subsisting grievances. Liberty so sought is granted.
The writ petition stands disposed off as not pressed.
