The petitioner apprehends her arrest in Naubatpur P.S. Case No. 200/2016, registered for the offences punishable under Sections 420, 467, 468, 471 and 120(B) of the Indian Penal Code.

The gist of the allegation is that the petitioner got appointment on the post of Prakhand Teacher on the basis of forged mark-sheet of B.E.T.E.T..

Learned counsel for the petitioner submits that a Public Interest Litigation bearing CWJC No. 15459/2015 was filed in which Division Bench of this Court had ordered to make enquiry and it was also ordered that if any person got appointment on the basis of forged certificate, resigns from the post within

Patna High Court Cr.Misc. No.46778 of 2016 (2) dt.07-12-2016 2/2 fifteen days from the date of notice, he shall not be prosecuted. The petitioner resigned from his service much before. The petitioner worked on the post of Prakhand Teacher for one and half years and she did not receive any salary and the petitioner is lady.

Considering the facts aforesaid, the petitioner above named in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Patna in connection with Naubatpur P.S. Case No. 200/2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) Rakhi U T
