This application for grant of regular bail arises out of Turkauliya (Banjariya) P.S. Case No.516 of 2022 registered for the offence punishable under Sections 302, 120B/34 of the Indian Penal Code and under Section 27 of the Arms Act.

As per the prosecution case, the deceased was killed by unknown persons. Subsequently, this petitioner and other accused persons are suspects in the case. Two similarly situated accused persons are put on trial and they have been acquitted. There is no direct material against the petitioner. He is in custody since 18.05.2023.

Considering the aforesaid facts, this application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran, in connection with Turkauliya (Banjariya) P.S. Case No.516 of 2022.
