The petitioner is the husband of respondent-wife. It is the case of the respondent that the petitioner has been working as a Government employee in Bokhara Block and is getting Rs. 40,000/- per month as salary, which the petitioner has denied, and has stated that though the petitioner is working under the Government on the post of Gram Awas Paryavekshak, but the employment is contractual and he is being paid a sum of Rs. 12,000/- per month only.
Learned Principal Judge, Family Court, Sitamarhi, while deciding the petition filed by the respondent-wife under Section 24 of the Hindu Marriage Act, in Matrimonial Case No. 199 of 2019, by order, dated 23.06.2022, has taken into consideration the statement of the petitioner that his salary is Rs.
Patna High Court C.Misc. No.517 of 2022(2) dt.10-11-2022 2/2 12,000/- per month and has awarded maintenance in favour of the respondent-wife at the rate of Rs. 4,000/- per month and Rs. 4,000/- per month for the minor child, who is living with the respondent-wife.
Taking into consideration the nature of the order and the fact that only Rs. 4,000/- has been awarded in favour of the respondent-wife and Rs. 4,000/- in favour of their minor child, I am not inclined to interfere with the impugned order. This application is, accordingly, dismissed.
