The petitioner seeks regular bail in connection with Haspura P.S. Case No. 165 of 2017 for the offences punishable under Section 420/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The allegation of the informant is that when three persons were apprehended by the police, they disclosed that one Munna Kumar was the main accused, who had kept huge quantities of illicit liquor. It is further alleged that the present petitioner is the father of the said Munna Kumar and as such he has also complicity in the present matter.
The learned counsel for the petitioner submits that
Patna High Court Cr.Misc. No.62796 of 2017 (2) dt.17-01-2018 2/2 the petitioner has a clean antecedent and he is in custody since 6.11.2017. It is further submitted that the son of the petitioner, against whom there is direct allegation, has been granted bail by this Court by order dated 14.11.2017 passed in Cr. Misc. No. 49160 of 2017.
Considering the nature of accusation, the period of custody already undergone and the fact that the petitioner has a clean antecedent, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned A.D.J.- VII cum Special Judge (Excise), Aurangabad (Bihar). in connection with Haspura P.S.
