JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-01-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Khagaria (Muffasil) P.S. Case No. 216 of 2015 registered under Sections-427, 307, 392 & other minor sections of the Indian Penal Code and 27 of the Arms Act.

Near about 72 named and several unknown persons are made accused in the present case. There is allegation that the petitioner and several other accused persons blocked NH-31 and when police party came there, they having become furious, not only pelted stones but also, made firing.

Admittedly, none has sustained any fire-arm injury and having more or less similar allegation, some co-accused have

Taking note of the aforesaid facts and circumstances as well as submission of the parties and also keeping in mind that the petitioner does not have any criminal antecedent and, no specific overt act has been attributed against him, let the petitioner named above, in the event of his arrest or surrender in the court below within four weeks from the date of receipt/production of copy of this order, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Khagaria (Muffasil) P.S. Case No. 216 of 2015 to the satisfaction of learned Chief Judicial Magistrate, Khagaria subject to condition as laid down u/S 438(2) of the Code of Criminal Procedure Code.
