The petitioner seeks bail in Ballia P.S. Case No. 239 of 2020, registered for the offence punishable punishable under Sections 272, 273, 120(B) and 34 of the Indian Penal Code and sections 30, 32 of the Bihar Prohibition and Excise Act, 2018. 319.68 litres of foreign liquor has been recovered from a truck and 315 litres of foreign liquor has been recovered from the house of co-accused Jalo Sah.

It is submitted that name of this petitioner has come in this case on the basis of confessional statement of co-accused who were apprehended on the place of recovery. No recovery has been made from conscious possession of this petitioner. Petitioner is neither driver nor owner of vehicle in question.
