This application for regular bail arises out of Dharara P.S. Case No. 115 of 2011(G.R. No. 7786 of 2011, ST No. 190/2016), disclosing offence punishable under Sections 147, 148, 149, 342, 302 and 504 of the Indian Penal Code and Section 27 of the Arms Act.

Petitioner's prayer for regular bail was earlier rejected by an order of this Court dated 19.01.2021, passed in Cr. Misc. No. 34061 of 2020. Petitioner is in custody since 03.05.2016. Learned counsel appearing on behalf of the petitioner has submitted that most of the witnesses have already been examined but none of them has supported the case of the prosecution as against the petitioner. He has further submitted

Patna High Court CR. MISC. No.54450 of 2021(3) dt.27-10-2021 2/2 that considering the petitioner's custody for more than five years and the fact that there is no evidence supporting the case of the prosecution at the trial, the petitioner deserves grant of regular bail.

Considering the fact that the petitioner is custody since 03.05.2016, this application is allowed. Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned Chief Judicial Magistrate, Munger, in Dharara P.S. Case No. 115 of 2011(G.R. No. 7786 of 2011, ST No. 190/2016).
