The petitioner seeks bail in a case registered under Section 25(1-B)a/26/35 of the Arms Act.

Prosecution case in short is that in course of checking, the informant saw two persons coming on motorcycle from Begusarai and seeing the police party, they tried to flee away but on chase, both of them including the petitioner were apprehended. On search, two country made pistols were recovered.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 23-02-2018. Charge sheet has already been submitted. One country made pistol with

Patna High Court CR. MISC. No.41810 of 2019(2) dt.08-07-2019 2/2 two magazines and one motorcycle are alleged to have been recovered. There is no compliance of Section 100 Cr.P.C. On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-Ist Class, Begusarai in connection with Barauni P.S. Case No. 64 of 2018.
