====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 19-12-2018 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Manihari P.S. Case No. 168 of 2018 instituted for the offence under Sections 354(A), 323, 504/34 of the Indian Penal Code and Section 8 of POCSO Act.

Counsel for the petitioner submits that petitioner has been implicated in the case due to local politics. In the written report the informant has alleged that his daughter aged about 9 years had gone to take tuition from this petitioner. He attempted to misbehave with her. He also attempted to remove her cloths.

The victim girl has given statement under Section 164 Cr. P.C. wherein she has stated that this petitioner

Petitioner is in custody since 27.7.2018 having clean antecedent.

Keeping in view the period spent by the petitioner in custody, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. 1st, Special Judge, Katihar, in connection with Manihari P.S. Case No. 168 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
