JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 28-07-2023 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 323, 241, 354, 498(A) , 379 and 34 of the Indian Penal Code and Section 3/4 of the D.P. Act but after investigation charge sheet has been submitted under Sections 341, 323, 498A, 504 and 506 of the IPC.

Allegation against the petitioner along with his family members is that they demanded land and Rs. 5 lacs as dowry from the informant, on denial, they assaulted the informant and tortured her. It is further alleged that petitioner's family members also assaulted the informant's family members. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Petitioner is

It is further submitted that petitioner along with his family members has neither demanded dowry nor tortured the informant. It is also submitted that informant used to quarrel with the petitioner as well from her in-laws. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. Moreover, he is languishing in judicial custody since 10.03.2023.

Learned APP appearing for the state and learned counsel for the informant have opposed the prayer of regular bail. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Charpokhari P.S. Case No. 51 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Bhojpur, Ara.
