JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 09-09-2015 The petitioner had come to this Court seeking his promotion and other consequential benefits. The direction was issued by this Court, and accordingly, Bihar
Patna High Court MJC No.3829 of 2012 (2) dt.09-09-2015 Agriculture University, Sabour, Bhagalpur, was required to comply with the same. While seeking to comply with the orders and seeking promotion to the petitioner, University made it conditional, in the sense, it disclosed that the Doctorate, which the petitioner claimed, was not bonafidely obtained and an inquiry was set up.
Le it be made clear that before this Court this issue was not raised, and as such, it is open for the University to conduct such inquiry and give such decision as it may think fit in that matter, but so long as no decision is finally taken, petitioner cannot be made to suffer for a decision that may come at a future date.
Accordingly, it is expected that all promotions including selection grade that are due to the petitioner including selection grade has to be duly given which, of course, would be subject to the correctness or otherwise of the Ph.D. Degree.
With this observation, this application stands disposed of.
